Terms & Conditions
Article 1 — Purpose & scope
These General Terms and Conditions of Sale apply as of right to our commercial relationships with our Clients. Any order placed by our Clients implies, as an essential and decisive condition, the unreserved acceptance of said conditions. These General Terms and Conditions of Sale prevail over any purchasing conditions, save express waiver by the company Neo Shuttle. No tolerance by Neo Shuttle, of whatever nature, importance, duration or frequency, may create a right or amount to a waiver of the right to later rely on any of these conditions.
Article 2 — Contractual documents
The documents making up the contractual relationship are:
- the quote;
- the text of the contract itself / the order;
- these General Terms and Conditions of Sale;
- on a supplementary basis, the Client’s documents insofar as they are not contrary to the specific conditions of the contract.
Each document prevails over the next in the order set out in the contract and, failing such indication, in the order set out in this article. In accordance with legal obligations, the documents are drafted in French.
Article 3 — Scope of the service
Neo Shuttle provides its clients with: a vehicle with driver according to the terms set out in the Order Form, the fuel required to complete the journey, the carriage of luggage and tolls, as well as insurance for the persons transported.
Article 4 — Pricing
Neo Shuttle makes the general price list for its services available to clients. These prices are subject to Value Added Tax (VAT) at the rate in force applicable to the nature of the service, namely 10% for transfers and 20% on hourly chauffeur hire.
Article 5 — Payments
To be validated, any order must be accompanied by a minimum of 30% of the quoted amount. The balance is payable to the driver at the end of the service, in cash or by bank card.
Article 6 — Cancellation conditions
For coach services, in the event of cancellation Neo Shuttle reserves the right to charge the following minima:
- “50%”: less than 3 days before the start date of the service.
For sedan and van services, in the event of cancellation Neo Shuttle reserves the right to charge the following minima:
- “0%”: more than 48 hours before the start date of the service, with the offer of a credit note valid for 1 year from the initial order date;
- “100%”: less than 24 hours before the start date of the service.
A full refund will only be effective where the cancellation option has been taken at the rate of €5 per booking. In all cases, the client’s absence at the agreed date and time of the appointment results in the full amount of the order being charged. The same applies if the information provided by the client is incorrect (flight number, contact details, etc.).
Article 7 — Compliance with regulations & safety
Neo Shuttle’s staff are required to comply with the rules in force, in particular regarding the driving of vehicles. No exemption from compliance with these rules may be allowed. Clients are also required to comply with the same rules; any contrary behaviour that could cause an accident or damage to the vehicle will be charged to said client.
Article 8 — Force majeure
Neo Shuttle may not be held liable for the non-performance or any other breach of its contractual obligations where such failure results from an external cause of force majeure. An external cause of force majeure is deemed to be any irresistible, unforeseeable and external event within the meaning of Article 1148 of the French Civil Code.
Article 9 — Data protection
Personal information concerning the Client is subject to data processing that has been declared to the C.N.I.L. (French data protection authority). This information is reserved for the exclusive use of the company Neo Shuttle. The Client has a right of access to and modification of the data concerning them (Article 34 of the French Data Protection Act of 6 January 1978).
Article 10 — Disputes
For any dispute that may arise from the relationship between Neo Shuttle and the client, the Marseille Commercial Court shall have sole jurisdiction.
